Agreement to Terms

By accessing or using OpenHack's website, platform, or services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services. These Terms constitute a legally binding agreement between you and OpenHack.

Description of Services

OpenHack provides AI-powered security scanning tools, including automated vulnerability detection, pull request security reviews, AI-assisted remediation, and related security analysis services. Our Services are designed to help developers and organizations identify and fix security vulnerabilities in their software.

Account Registration

To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not use our Services to scan, test, or analyze software or systems for which you do not have explicit authorization. You may not attempt to circumvent any security measures, rate limits, or access controls. You may not use our Services to develop competing products or for any purpose that violates applicable laws or regulations.

Your Data and Content

You retain all rights to the source code, repositories, and other content you submit to our Services for analysis. By submitting content, you grant OpenHack a limited, non-exclusive license to process and analyze that content solely for the purpose of providing our Services. We do not claim ownership of your content and will not use it for purposes other than delivering our Services, except in aggregate, anonymized form to improve our scanning capabilities.

Intellectual Property

The OpenHack platform, including its software, algorithms, models, documentation, and branding, is owned by OpenHack and protected by intellectual property laws. Our open-source components are licensed under their respective open-source licenses. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without prior written consent.

Payment and Billing

Certain features of our Services require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law. We reserve the right to change our pricing with 30 days notice.

Security Testing Authorization

You represent and warrant that you have all necessary rights and authorizations to submit any code, software, or systems to OpenHack for security analysis. You are solely responsible for ensuring that your use of our scanning tools complies with all applicable laws and any agreements you have with third parties. OpenHack is not liable for any unauthorized scanning or testing activities conducted through our Services.

Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that our Services will identify all vulnerabilities in your software, that our findings will be free of false positives, or that our Services will be uninterrupted or error-free. Security scanning is inherently limited, and our Services should be used as one component of a comprehensive security program.

Limitation of Liability

To the maximum extent permitted by law, OpenHack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of our Services. Our total liability for any claims arising under these Terms shall not exceed the amount you paid to OpenHack in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless OpenHack and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our Services, your violation of these Terms, or your violation of any rights of a third party.

Termination

We may suspend or terminate your access to our Services at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use our Services will immediately cease, and we may delete your account data in accordance with our Privacy Policy.

Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Services after any modifications constitutes your acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms constitute the entire agreement between you and OpenHack regarding our Services and supersede all prior agreements.
