Terms of Service

1.1By accessing or using the Services, you agree to these Terms. If you do not agree, you may not use the Services. These Terms form a binding agreement between you and OpenHack.

1.2If you use the Services for an organization, you represent that you have authority to bind that organization. In that case, “you” includes the organization.

2.1OpenHack provides security scanning and testing tools, including codebase scanning, pull request security reviews, dependency analysis, AI-assisted remediation, pentesting features, and related managed services.

2.2Features, models, limits, and availability may differ by plan and may change as the Services develop. Beta or preview features may be incomplete, changed, or discontinued at any time.

3.1You must provide accurate, current, and complete registration and billing information. You are responsible for your credentials and all activity under your account.

3.2Each individual must use their own login. You may not share credentials, sell or transfer an account, impersonate another person, or create accounts using false, disposable, or misleading information.

3.3Plan member limits apply to actual users. You may not rotate, recycle, or share seats to avoid the member limit for your plan.

4.1OpenHack currently offers the following plans. The pricing page controls the current feature matrix, usage limits, and generally available prices.

4.2Pro and Max are monthly, flat-rate subscriptions, not per-seat subscriptions. Plans may include usage allowances that expire at renewal or the end of the applicable plan cycle, have no cash value, are not transferable, and do not roll over unless OpenHack expressly states otherwise. Current plan details are shown on the pricing page and in your account.

4.3Paid subscriptions are billed in advance and automatically renew for successive monthly terms until canceled. Cancellation takes effect at the end of the current paid term. Fees are non-refundable except where required by law or expressly stated in an order form.

4.4Enterprise pricing, usage, support, and service commitments are governed by the applicable order form. If an order form conflicts with these Terms, the order form controls for that Enterprise purchase.

4.5We may change prices or plan features. For an active paid subscription, a price change will apply no earlier than the next renewal after reasonable notice, unless a different period is required by law.

5.1Unless an offer expressly says otherwise, a free trial, introductory period, coupon, signup credit, or other promotion is limited to one per person and one per organization. Eligibility is also limited across accounts controlled by, created for, or acting on behalf of the same person or organization.

5.2You may not obtain or attempt to obtain additional trials, promotions, or credits by creating or using multiple accounts, aliases, organizations, payment methods, devices, automated signups, or other means intended to avoid an eligibility or usage limit. Coordinating with another person to do so is also prohibited.

5.3Trials and promotional credits are personal to the eligible account, have no cash value, are not transferable, may not be resold, and may expire. Unless the offer says otherwise, unused promotional value does not roll over or convert to cash.

5.4If we reasonably determine that a trial, promotion, free plan, or credit has been abused, we may deny eligibility, revoke unused credits, cancel the promotion, restrict usage, suspend or terminate related accounts, and block future promotional access. We may apply these remedies across accounts we reasonably determine are related.

5.5When a payment method is required, the selected paid plan begins and the payment method is charged when the trial or promotional period ends unless you cancel before that time. The signup flow will state the applicable trial length and renewal price.

6.1You may use the Services only for lawful purposes. You may not interfere with the Services; bypass access controls, rate limits, credit limits, or plan restrictions; scrape or automate account creation; probe OpenHack systems without authorization; or use the Services to develop a competing service.

6.2You may not use the Services to distribute malware, facilitate unauthorized access, harm another person, violate privacy or intellectual property rights, or violate applicable law.

7.1You represent and warrant that you have all rights and authorizations necessary to submit or test any code, repository, application, network, or system through the Services.

7.2You are responsible for defining an appropriate testing scope, protecting production systems and data, and complying with applicable laws and third-party agreements. OpenHack is not responsible for testing performed without authorization.

8.1You retain ownership of source code, repositories, prompts, configurations, and other content you submit to the Services (“Your Content”).

8.2You grant OpenHack a limited, non-exclusive license to host, process, transmit, reproduce, and analyze Your Content only as needed to provide, secure, support, and maintain the Services and to comply with law.

8.3Our handling of personal information is described in the Privacy Policy. You are responsible for having all notices, consents, and legal bases needed to provide Your Content to OpenHack.

9.1Security findings, suggested fixes, generated exploits, model output, and other analysis may be incomplete, inaccurate, or unsuitable for your environment. You are responsible for reviewing and testing output before relying on it or deploying it.

9.2OpenHack does not guarantee that the Services will identify every vulnerability, eliminate false positives, prevent an incident, or satisfy any particular audit, certification, or compliance requirement.

10.1OpenHack owns the managed platform, documentation, branding, and related technology, excluding Your Content and third-party materials. Open-source components are governed by their applicable open-source licenses.

10.2These Terms do not grant permission to use OpenHack trademarks, logos, or brand assets except as needed to identify your authorized use of the Services.

11.1We may suspend or restrict access when reasonably necessary to protect the Services, enforce these Terms, respond to suspected fraud or abuse, prevent harm, address nonpayment, or comply with law.

11.2You may cancel your subscription or stop using the Services at any time. We may terminate these Terms or an account for a material breach. Where practical, we will provide notice and an opportunity to cure, but immediate action may be necessary for fraud, abuse, security risk, unlawful conduct, or repeated violations.

11.3On termination, your right to use the Services ends. We may delete account data in accordance with our retention practices and Privacy Policy. Sections that by their nature should survive termination will survive.

12.1To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

13.1To the maximum extent permitted by law, OpenHack will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, use, goodwill, or business opportunities arising from or related to the Services.

13.2To the maximum extent permitted by law, OpenHack's total liability arising from or related to the Services or these Terms will not exceed the amount you paid to OpenHack during the twelve months before the event giving rise to the claim.

14.1You will indemnify, defend, and hold harmless OpenHack and its officers, directors, employees, and agents from claims, damages, losses, liabilities, and reasonable legal fees arising from your use of the Services, Your Content, your security testing, your violation of these Terms, or your violation of another party's rights.

15.1We may update these Terms. We will post the revised version and update the “Last updated” date. If a change materially reduces your rights, we will provide reasonable notice when required by law. Continued use after the effective date means you accept the revised Terms.

16.1These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware.

17.1If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms, the Privacy Policy, and any applicable order form constitute the entire agreement concerning the Services.
